PuraCars Terms and Conditions for Mechanics

Welcome to PuraCars! These Terms and Conditions ("Terms") govern your access to and use of the PuraCars platform ("Platform") as a verified mechanic ("Mechanic"). By registering as a Mechanic and using the Platform, you agree to comply with these Terms. If you do not agree to these Terms, you may not use the Platform as a Mechanic.

1. Eligibility and Registration

1.1 Eligibility Requirements: To register as a Mechanic, you must be at least 18 years old and possess all required licenses, certifications, and insurance to perform mechanical services in Costa Rica.

1.2 Registration Process: To become a verified Mechanic on PuraCars, you must complete the registration process, which includes submitting your personal information, proof of certification, and any other documents requested by PuraCars for verification purposes.

1.3 Accuracy of Information: You agree to provide accurate, current, and complete information during the registration process and to update such information as necessary to keep it accurate, current, and complete.

2. Community Standards

2.1 Positive Interactions: PuraCars is a community that promotes positive and constructive interactions. As a Mechanic, you agree to engage in respectful and professional communication with all car owners ("Customers").

2.2 Offering and Asking for Help: The PuraCars community operates on two main principles: offering help or asking for help regarding car-related issues. Mechanics are expected to adhere to these principles in all interactions.

2.3 Prohibition of Negative Reviews: The PuraCars platform discourages negative reviews. Instead, we encourage open communication between Mechanics and Customers to resolve any disputes or issues directly and amicably.

3. Services and Responsibilities

3.1 Provision of Services: As a Mechanic, you agree to provide high-quality and professional mechanical services to Customers. You must ensure that all work performed meets the standards of the automotive industry and complies with all applicable laws and regulations.

3.2 Service Availability: You are responsible for maintaining your availability as indicated on the Platform’s live calendar. If you are unable to fulfill a scheduled service, you must notify the Customer and PuraCars promptly.

3.3 Emergency Services: Mechanics may opt to participate in the SOS emergency call feature. If you choose to participate, you agree to respond promptly to emergency requests and provide necessary assistance to Customers in distress.

4. Payment and Fees

4.1 Service Fees: Mechanics will receive payment for services rendered to Customers through the Platform. PuraCars will deduct a service fee from each transaction, the amount of which will be specified during the registration process.

4.2 Payment Processing: Payments will be processed through a third-party payment processor. Mechanics must provide accurate and up-to-date payment information to receive payments. PuraCars is not responsible for any errors or delays caused by the payment processor.

4.3 Subscription Fees: Mechanics may be required to pay a subscription fee to access certain features or benefits on the Platform. Subscription fees are non-refundable unless otherwise specified in these Terms.

5. Conduct and Compliance

5.1 Professional Conduct: Mechanics must conduct themselves professionally at all times when interacting with Customers and other members of the PuraCars community.

5.2 Compliance with Laws: Mechanics must comply with all applicable local, state, and national laws and regulations related to the provision of mechanical services.

5.3 Prohibition of Fraudulent Activities: Mechanics must not engage in any fraudulent, deceptive, or unlawful activities while using the Platform.

6. Dispute Resolution

6.1 Customer Disputes: In the event of a dispute between a Mechanic and a Customer, PuraCars encourages direct communication between the parties to resolve the issue amicably. If a resolution cannot be reached, PuraCars may, at its discretion, mediate the dispute.

6.2 Binding Arbitration: Any disputes arising from or related to these Terms will be resolved through binding arbitration in accordance with the laws of Costa Rica. Mechanics waive their right to bring claims in a court of law, except for matters that may be taken to small claims court.

7. Termination and Suspension

7.1 Termination by Mechanic: You may terminate your registration as a Mechanic at any time by opting out of your membership on the PuraCars App.

7.2 Termination by PuraCars: PuraCars reserves the right to suspend or terminate your access to the Platform at any time for any reason, including but not limited to violations of these Terms, fraudulent activities, or conduct that is harmful to the PuraCars community.

7.3 Effect of Termination: Upon termination, you will no longer have access to the Platform as a Mechanic, and any outstanding payments owed to you will be processed in accordance with these Terms.

8. Limitation of Liability

PuraCars is not liable for any direct, indirect, incidental, special, consequential, or punitive damages arising from or related to your use of the Platform as a Mechanic. This includes, but is not limited to, damages for loss of profits, goodwill, use, data, or other intangible losses.

9. Changes to Terms

PuraCars reserves the right to modify these Terms at any time. Any changes will be effective immediately upon posting on the Platform. Your continued use of the Platform as a Mechanic after any such changes constitutes your acceptance of the new Terms.
