Welcome to PuraCars! These Terms and Conditions ("Terms") govern your access to and use of the PuraCars platform ("Platform") as a car owner or customer ("Customer"). By using the Platform, you agree to comply with these Terms. If you do not agree to these Terms, you may not use the Platform as a Customer.
1.1 Eligibility Requirements: To use the Platform, you must be at least 18 years old and possess a valid driver’s license and vehicle registration.
1.2 Registration Process: To use PuraCars, you must create an account by providing your personal information, vehicle details, and any other documents requested by PuraCars for verification purposes.
1.3 Accuracy of Information: You agree to provide accurate, current, and complete information during the registration process and to update such information as necessary to keep it accurate, current, and complete.
2.1 Positive Interactions: PuraCars is a community that promotes positive and constructive interactions. As a Customer, you agree to engage in respectful and professional communication with all mechanics ("Mechanics").
2.2 Offering and Asking for Help: The PuraCars community operates on two main principles: offering help or asking for help regarding car-related issues. Customers are expected to adhere to these principles in all interactions.
2.3 Prohibition of Negative Reviews: The PuraCars platform discourages negative reviews. Instead, we encourage open communication between Customers and Mechanics to resolve any disputes or issues directly and amicably.
3.1 Accurate Service Requests: Customers are responsible for providing accurate and detailed descriptions of the issues with their vehicle when requesting services through the Platform.
3.2 Payment for Services: Customers agree to pay for all services rendered by Mechanics through the Platform. Payments must be made promptly and in accordance with the fees set forth during the service request.
3.3 Availability for Scheduled Services: Customers must be available at the agreed-upon time and location for scheduled services. If you need to cancel or reschedule a service, you must do so within the timeframe specified by the Platform.
3.4 Respectful Conduct: Customers must conduct themselves respectfully and professionally when interacting with Mechanics. Abusive or inappropriate behavior will not be tolerated and may result in suspension or termination of your account.
4.1 Service Fees: Customers will be charged for services rendered by Mechanics through the Platform. The fees will be displayed to the Customer at the time of the service request.
4.2 Payment Processing: Payments will be processed through a third-party payment processor. Customers must provide accurate and up-to-date payment information to complete transactions. PuraCars is not responsible for any errors or delays caused by the payment processor.
4.3 Cancellation Fees: Customers may be subject to cancellation fees if they cancel a service request outside of the specified cancellation window. The amount of the cancellation fee will be displayed at the time of cancellation.
5.1 Compliance with Laws: Customers must comply with all applicable local, state, and national laws and regulations related to the operation and maintenance of their vehicles.
5.2 Prohibition of Fraudulent Activities: Customers must not engage in any fraudulent, deceptive, or unlawful activities while using the Platform.
5.3 Responsibility for Vehicle: Customers are responsible for the condition and legality of their vehicles. PuraCars and its Mechanics are not responsible for any pre-existing conditions, defects, or violations associated with a Customer's vehicle.
5.4 Mechanic’s Scope of Responsibility: Mechanics are only responsible for the specific repairs or services that the Customer explicitly requests through the Platform. Mechanics are not liable for any additional issues or damages that are not directly related to the requested repair.
6.1 Mechanic Disputes: In the event of a dispute between a Customer and a Mechanic, PuraCars encourages direct communication between the parties to resolve the issue amicably. If a resolution cannot be reached, PuraCars may, at its discretion, mediate the dispute.
6.2 Binding Arbitration: Any disputes arising from or related to these Terms will be resolved through binding arbitration in accordance with the laws of Costa Rica. Customers waive their right to bring claims in a court of law, except for matters that may be taken to small claims court.
7.1 Termination by Customer: You may terminate your account as a Customer at any time by providing written notice to PuraCars.
7.2 Termination by PuraCars: PuraCars reserves the right to suspend or terminate your access to the Platform at any time for any reason, including but not limited to violations of these Terms, fraudulent activities, or conduct that is harmful to the PuraCars community.
7.3 Effect of Termination: Upon termination, you will no longer have access to the Platform as a Customer, and any outstanding payments owed for services rendered will be processed in accordance with these Terms.
PuraCars is not liable for any direct, indirect, incidental, special, consequential, or punitive damages arising from or related to your use of the Platform as a Customer. This includes, but is not limited to, damages for loss of profits, goodwill, use, data, or other intangible losses.
PuraCars reserves the right to modify these Terms at any time. Any changes will be effective immediately upon posting on the Platform. Your continued use of the Platform as a Customer after any such changes constitutes your acceptance of the new Terms.
